Child Support Grant Appeal 2026 — How to Appeal a Declined Application

by Admin | Jul 31, 2026 | Child Support Grant

A declined Child Support Grant application is not the end of the road. SASSA is required by law to give you a reason for the decline, and you have the right to appeal that decision within 90 days.

This guide walks through the appeal process step by step, what documents to include, and how to escalate if your appeal is also declined.

Before You Appeal — Get the Reason in Writing

The most important thing to do immediately after being declined is to ask the SASSA officer for the written decline reason — sometimes called the "G-form" or decline notice.

Without knowing the exact reason, you cannot build an effective appeal. SASSA is required to provide this, so do not leave the office without it.

If you were declined via SMS or letter and the reason is not clear, call 0800 60 10 11 or visit your nearest SASSA office and ask for the written reason on your specific application reference number.

The Two-Stage Appeal Process

Stage 1: Internal Reconsideration (within 30 days)

The first step is to request an internal reconsideration at SASSA — this is a review by a senior SASSA officer, not an external tribunal.

How to do it:

  1. Visit the SASSA office where you originally applied
  2. Bring your original application receipt and the written decline reason
  3. Ask to lodge an internal reconsideration and bring any supporting documents that address the specific reason for decline
  4. A SASSA officer will capture your reconsideration request

This must be done within 30 days of the decline date.

Stage 2: Independent Tribunal Appeal (within 90 days)

If your internal reconsideration is also declined — or if 30 days have passed and you haven't heard back from the reconsideration — you can escalate to the Independent Tribunal for Social Assistance Appeals (ITSAA).

The ITSAA operates independently from SASSA and reviews decisions with fresh eyes. This process is completely free and does not require a lawyer.

How to do it:

  1. Visit any SASSA office and ask to lodge a formal appeal with ITSAA
  2. Alternatively, contact ITSAA directly through the Department of Social Development at dsd.gov.za
  3. Submit your supporting documents along with the appeal
  4. ITSAA typically issues a decision within 60 to 90 days and notifies you by SMS or letter

This must be done within 90 days of the original decline date.

Black Sash offers free paralegal assistance to caregivers navigating the appeal process. They have offices and advice desks nationally and can help you prepare your documents and understand your rights.

What to Include in Your Appeal

Your appeal is strongest when it directly addresses the specific reason SASSA gave for declining your application. Here is what to include based on the most common decline reasons:

"Income above the means test threshold"

  • 3 months of bank statements showing your average monthly income
  • A sworn affidavit (from a Commissioner of Oaths) explaining any unusually high months — for example, if you received a once-off payment, a refund, or money from a family member
  • If employed: your payslip confirming your regular monthly income
  • If unemployed: an affidavit confirming no income and your UIF blue book or discharge certificate

The SASSA officer averages your 3-month bank statement. If one month was unusually high due to a non-recurring deposit, an affidavit explaining this is often enough to overturn the decline.

"Child not residing with applicant"

  • A letter from the child's school confirming the child's home address and that you are listed as the responsible caregiver
  • A municipal affidavit or councillor's letter confirming the child lives at your address
  • A social worker's report confirming the child's living arrangement

"Primary caregiver status not established" (for non-parents)

  • An affidavit from the biological parent(s) confirming you are the primary caregiver
  • A social worker's report
  • School records showing you as the contact person and caregiver
  • Medical records where you are listed as the child's guardian

"Child already registered on another caregiver's grant"

This requires the existing caregiver to cancel their grant first. Once cancelled, SASSA must confirm the cancellation before your application can be processed. Ask the other caregiver to visit SASSA to cancel, then follow up with your application.

"Missing or incorrect documents"

Gather the missing documents and resubmit. For a list of every document required by situation, see our Child Support Grant documents guide.

"Child not South African citizen or permanent resident"

If the child is a refugee child or has a Section 22 permit, this should not have been the reason for decline following the 2017 Constitutional Court ruling. Include the child's valid permit documentation and reference the Constitutional Court ruling in your appeal.

What Happens If You Win the Appeal?

If the ITSAA rules in your favour, SASSA is required to:

  • Approve your application from the original date you applied
  • Pay back-pay for every month your grant was incorrectly declined
  • Process the back-pay in the next available payment batch

Back-pay can accumulate to a significant amount if the appeal process took several months. SASSA pays the full arrears in a single lump sum payment.

What Happens If Your Appeal Is Also Declined?

If ITSAA declines your appeal, that decision is final for that specific application. However:

  • You can reapply in the next cycle if your circumstances change or if new evidence becomes available
  • You can consult a legal aid organisation if you believe the ITSAA process was procedurally flawed — Legal Aid South Africa (legal-aid.co.za) provides free legal advice on social grant matters

The 90-Day Deadline Is Strict

Do not delay. The 90-day window runs from the date of the original decline notice, not from when you received it. If you miss the 90-day window, you cannot appeal that specific decision — you would need to submit a fresh application instead.

If you are unsure of your decline date, call 0800 60 10 11 with your application reference number and they can confirm it.

Protecting Your Grant Going Forward

Once your appeal is successful and your grant is approved, take steps to keep it running smoothly:

  • Keep your banking details up to date — see our guide on changing your SASSA payment method
  • Complete the annual life certificate if required (for grants collected through an institution or procurator)
  • Notify SASSA promptly if your income increases above the means test threshold
  • Notify SASSA if the child moves to a different caregiver
  • Be aware of your child's 18th birthday — see our guide on when the Child Support Grant stops

Frequently Asked Questions

Can I appeal if I missed the 30-day reconsideration window? Yes — you can still go directly to the ITSAA appeal within the 90-day window, even if you missed the 30-day internal reconsideration deadline. The 30-day reconsideration and 90-day ITSAA appeal are separate processes.

Do I need a lawyer to appeal? No. The appeal process is designed to be accessible without legal representation. However, Black Sash and Legal Aid South Africa can assist you for free if you need support.

Can I appeal by phone or WhatsApp? No. The appeal must be submitted in person at a SASSA office or through a formal written process. Phone and WhatsApp can be used to ask questions, but not to submit the official appeal.

How long will I wait for an ITSAA decision? Typically 60 to 90 days. During this period, continue checking in with SASSA on 0800 60 10 11 for any updates. You will be notified by SMS when a decision is made.

Can I apply for the grant again while my appeal is pending? Your appeal covers the original declined application. You can also submit a fresh application simultaneously — this is sometimes the faster route if your circumstances have changed since the original application.

My grant was suspended, not declined — is this the same process? A suspension is different from a decline. A suspended grant can often be reinstated by resolving the specific trigger (completing a review, submitting a life certificate, or clarifying a change in circumstances). Contact SASSA on 0800 60 10 11 first to understand the reason for suspension before going through the full appeal process.
